Wills

According to various studies, between 60% and 70% of the UK population do not have a Will. We understand that not everybody wants to think about what will happen after they die and the thought of putting it down in writing can be upsetting.

However, writing a Will is the only way to ensure that those that you want to benefit from your personal assets after you have passed away are able to do so. It ensures that your wishes are set out clearly and you can choose who you want to deal with matters on your behalf. By not planning for the future, you could be leaving your family with extra work and hassle during what is already an emotionally charged time.

At The London Probate Company our main aim is to make you feel comfortable talking about these sensitive matters, to enable you to plan effectively for the future, and to give you the peace of mind that your family will have one less thing to worry about.

Statutory Notices

The statutory notices are advertisements published in the London Gazette and a local paper giving notice of the personal representatives’ intention to distribute.

They give notice to creditors and other people who may have an ‘interest’ in the estate that any claim must be received by a specific date (at least two months from the date of the notice).

Examples of people who may have an interest include:

  • anyone who thinks they are owed money by the deceased
  • a person claiming there is a later Will
  • a person claiming he or she entered into an agreement with the deceased entitling him or her to a share in the deceased’s property
  • a person claiming to be a beneficiary where the beneficiaries are not named specifically (eg where the Will leaves “all my estate to my children” and the person claims to be an illegitimate child whose existence was not previously known to the rest of the deceased’s family or under an intestacy where the person claims to be the nearest entitled relative whose relationship to the deceased had been concealed from the rest of the family). tors of the deceased’s estate.

To comply with this Act ,we would on your behalf advertise the intention to convey or distribute the estate through a notice placed in The London Gazette and the deceased’s local newspaper, setting out a period of at least two months for any interested parties to send the particulars of their claim to the Personal Representative. After this time period it will not be possible for someone to make a claim against the Estate.

Stop unwanted mail to the home of the deceased

Receiving mail addressed to the deceased can be very distressing. We can help to stop mail being sent to the address of the deceased by registering with ‘The Bereavement Register’. This service is completely free of charge and within 2-3 months of registering all marketing and sales literature will stop.

Contentious Estates

Losing a loved one is one of the most difficult things any of us have to go through. The grieving process can be made even more difficult when there is a dispute over a Will.
